Coulter Roache Lawyers on changes to will challenges

Coulter Roache LogoEmily Capill, Lawyer at Coulter Roache Lawyers joined the program to talk about changes to the law regarding challenges to wills.

Previously, any person who could show that a willmaker had a moral duty to provide for them and failed to do so could challenge the person’s will for greater provision.

There have been cases where the willmaker’s distant relatives or friends have brought claims against the willmaker’s estate for provision.

The new laws which came into effect on 1 January 2015, now make it more difficult for someone to successfully challenge a will.
